Since consumerchanneldata.co.uk is offering non-tangible irrevocable reports and outputs, we do not issue refunds once outputs with postal
and/or email address appended have been downloaded. As a customer, you are responsible for understanding this upon registering to our system
and prior to the downloading of the output file.

However, we realise that exceptional circumstance can take place with regard to the output we have provided. You can contact our Support

Costs are only applied once a user has actually agreed to the costs and output the appended data. We are unable to cancel the job
once its past this stage then charges will be raised as advised via the preferred payment option. 

In the event when the output data has been downloaded and is not in line with your expectations, consumerchanneldata.co.uk will be 
unable to arrange for a refund. Kindly refer to our Refund Policy.

    1.  Definitions and Interpretation 

    1.1 In these Consumer Channel Data (CCD) Terms and Conditions unless the context shall otherwise require the following words and 
        expressions shall have these meanings assigned to them:

        Act means as relevant the Data Protection Act 1998, the Data Protection Directive 95/46/EC and the Privacy and Electronic Communications 
        (EC Directive) Regulations 2003 (as well as any amendments or replacements thereof, including any legislation implementing EC 
        Directives 97/66/EC and 2002/58/EC);
        Agreement means these CCD Terms and Conditions;
        CCD is a service owned and operated by Consumer Cloud Services Limited, Top Floor, 14 Athol Street, Douglas, Isle of Man, IM1 1JA, 
        Company registration number 005365V, VAT number 002305153;

        CCD Website means all functions available to users on www.consumerchanneldata.co.uk, but not the output of CCD Data and any 
        subsequent usage of CCD Data;
        CCD Data refers to the output of Contact Channel(s) from CCD Website as more particularly described in the Order Confirmation;
        CCD’s Standard Terms and Conditions means these terms and conditions; 
        Client means the Party or Parties who are using the CCD Website and/or outputting CCD Data;
        Cancellation Policy means the policy relating to cancellation of output data after the Order Confirmation has been approved as published on 
        Codes of Practice means best practice guidelines issued from time to time by any regulator or regulators in relation to the Act;
        Commercial Relationship means a relationship established between the End User and an individual as a result of (a) that individual 
        purchasing products and/or services (including on line and/or subscription services) from the End User or (b) where there is no 
        such purchase, a certain degree of communication between the End User and that individual where that communication (i) is initiated 
        by that individual, (ii) relates to that individual’s request for information, or (iii) consists in or relates to a response to a 
        questionnaire or survey, a response to a competition or sweepstake, or proven offline contact;

        Confidential Information means any information, data or know-how including but not limited to that which relates to (in the case of 
        CCD any CCD database or databases or extracts from any of them or to any part or parts of any CCD database or databases and 
        all CCD Data). 
	    Confidential Information does not include information that:
            •   is in the possession of the receiving Party at the time of the disclosure;
            •   becomes public knowledge without any action of either Party;
            •   was independently developed or prepared by either Party; or
            •   is required to be disclosed by law or by any regulator to whose regulation the disclosing Party is subject.

        Consumer Channel Data (CCD) means the whole service, including CCD Website, CCD Data and all associated systems and procedures; 
        Contact Channel means the media channel or channels via Post or Email;
        Customer means an individual who the End User has had a Commercial Relationship with;

        Customer (“Donor”) means any End User that is a charity then the term “Customer” that appears on CCD will effectively apply to a Donor, 
        where the Donor relates to a person who has, at some time, donated to the End User whose data is being submitted to CCD; 
        Dispute Policy Procedure means the procedure relating to disputes published on www.consumerchanneldata.co.uk.
        Email means the Contact Channel of email; 

        End User means as relevant the Client and/or the third party specified in the Order Confirmation that is acquiring or being granted the 
        right to use CCD Data;

        Names mean the names of individuals whose details are contained in the CCD Data;
        NCOA Update is built exclusively from data sourced from the Royal Mail’s Redirection Service. Data is collected directly from the 
        Redirection application forms completed by consumers who are in the process of moving home. Use of the file is prohibited from certain 
        companies and organisations.
        Order Confirmation means an order confirmation emanating from CCD to the Client granting them and/or the End User to make use of 
        CCD Data;

        Output means a download from CCD of CCD Data by or on account of the Client utilising the Software;

        Party means either CCD or the Client; 

        Personal Data means the personal data (as that term is defined in the Act) contained in the CCD Data;

        Post means the Contact Channel of mailing;

        Privacy Policy means the policy relating to privacy published on www.consumerchanneldata.co.uk;

        Purpose means the purpose of supplying CCD Data pursuant to the Agreement or any Order Confirmation which unless stated otherwise in 
        the Order Confirmation is as a source for contacting a Customer;
        Refund Policy means the policy relating to refunds published on www.consumerchanneldata.co.uk
        Software means a secure file transfer protocol, a protocol used to transfer files between a PC and an embedded device using RS-232 
        or any other similar secure protocols which allows an End User to download CCD Data.

    1.2 CCD has the right to revise and amend these Terms and Conditions from time to time as published on www.consumerchanneldata.co.uk. 
          The Client will be subject to the policies and terms in force at the time that the Client orders the CCD Data as evidenced by the 
          Order Confirmation, but subject to (and to the extent of) any changes therein as may from time to time be required by law or 
          regulatory authority.

    2.  CCD Website usage and access

    2.1 By accessing and using the CCD website, you agree to be bound by the terms and conditions set out below and our Privacy Policy. 
          Your continued use constitutes your acceptance of the current Terms and Conditions and Privacy Policy.  If you do not accept these 
          Terms and Conditions or our Privacy Policy, please do not continue to use the CCD Website.  These terms and conditions are effective 
          from February 2014. 

    2.2 Consumer Channel Data is part of Consumer Cloud Services Ltd, a company registered in Isle of Man.  Our registered office is 
          Top Floor, 14 Athol Street, Douglas, Isle of Man, IM1 1JA. Company registration number 005365V. VAT number 002305153.

    2.3 The CCD Website and its contents (including the design, layout, appearance, graphics, any documents and references to names of 
          products or services) are protected by intellectual property rights, including copyright, and are either owned by or licensed to 
          CCD to use. CCD, the ‘CCD’ logo (Isle of Man Registration Number 005365V), and may not be reproduced without our permission.

    2.4 You undertake not to copy, store in any medium (including in any other website), distribute, modify, or otherwise make any content 
          on the CCD Website available to anyone else without the prior written permission of CCD.

    2.5 If you upload or submit any non-personal information or material to CCD Website in the course of using any products or services of 
          CCD Website, such information or materials will not be deemed to be confidential.  In uploading or submitting any non-personal 
          information to CCD Website, you agree to grant CCD an unrestricted, irrevocable licence to use, reproduce, display, perform, modify, 
          transmit and distribute the information or materials and agree that CCD may use any ideas, concepts, know-how or techniques you 
          upload or submit for any purpose. 

    2.6 Whilst we try to ensure that the information contained on CCD Website is accurate and up to date, we cannot be responsible for any 
          inaccuracies in the content. The CCD Website and content is provided "AS IS" and on an "AS AVAILABLE" basis without any representation 
          or endorsement and without warranty of any kind whether express or implied, including but not limited to the implied warranties of 
          satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. 

    2.7 CCD Website contains links to relevant third party websites which are not within our control.  We are not responsible for these websites 
          in any way.  When clicking on a particular link and leaving CCD Website, it is your responsibility to check the terms and conditions 
          and Privacy Policy on any other website you visit. 

    2.8 You may not link to the CCD Website from another website without CCD’s express permission. 

    3.  Terms of Data Supply 

    3.1 The Client and/or End User shall have the right to use the CCD Data but without limitation not to copy, alter, manipulate, 
          adapt or license others to use CCD Data.
    3.2 Permit the Client and/or End User to use in perpetuity but not to re-sell. 

    3.3 The Client and/or End User accepts that CCD Data may contain goneaways, deceased’s, dead and wrong numbers, e-mail bouncebacks 
          and inaccuracies.
    3.4 The Client and/or End User accepts that no guarantees are offered for response, contact or open rates, click-throughs or 
          deliverability through any Contact Channel in respect of CCD Data.

    3.5 The Client and/or End User shall comply at all times with clause 6.

    4.  Calculation and Payment of fees 

    4.1 On generating the Order Confirmation the Client agrees to be bound by the terms of the Agreement including fee calculations 
           regardless of whether any CCD Data Output is used by the Client and/or End User.
    4.2 If there are any issues or deficiencies relating to CCD Data then the client should refer to the Refund Policy as published on CCD Website.

    4.3 The Client acknowledges any queries relating to CCD Data may not be used as a reason for payment to be withheld or delayed.

    4.4 The Client acknowledges that any re-supply of CCD Data or goodwill credit on account will be at CCD’s sole discretion. 

    4.5 Any queries in respect of the contents of an invoice must be received no later than 10 days from the date of receipt after which 
          point the invoice shall be deemed valid and payable and may not thereafter be disputed.
    4.6 CCD reserves the right to charge interest on any sums not paid by the due date for payment at the greater of:
           •	4% per annum over the base rate of Barclays Bank PLC ; or
           •	8% per annum.

    In addition, CCD reserves the right to charge the Client its legal and other costs plus any VAT should any sums not be paid but due for 
    payment be referred to CCD’s solicitors or other representatives.

    5.  Data Usage 

    5.1 The Client and/or End User is responsible for maintaining the cleanliness of CCD Data prior to its use by screening against 
           internal and proprietary suppression files as required by the Applicable Regulations and accepted industry best practice.

    5.2 The Client and/or End User undertakes that it will at all times comply with the provisions of Applicable Regulations in respect 
           of the use, storage and transfer of CCD Data and that it will not violate any law including but not limited to the Act and all laws 
           of the United Kingdom governing advertising practices (including but not limited to advertising on the internet), and/or any 
           Applicable Regulations.	
    5.3 NCOA Update usage is prohibited for some companies and organisations which a typical redirection customer would not expect or desire to
           have access to their redirection information and new addresses. The following agencies are not allowed access - Debt Collection Agencies, 
           Credit Reference Agencies for the purposes of credit referencing, Police forces, Serious Organised Crime Agency, HM Revenue & Customs,
           The intelligence services (these are primarily the Security Service, the Secret Intelligence Service and Government Communications HQ),
           Scottish Crime and Drug Enforcement Agency, Financial Services Authority, Gangmasters Licensing Authority, HomeOffice, Gambling 
           Commission, Information Commissioner, Serious Fraud Office, Criminal Cases Review Commission, Scottish Criminal Cases Review 
           Commission, Civil Nuclear Constabulary, Office of the Police Ombudsman for Northern Ireland, Independent Police Complaints 
           Commission, Food Standards Agency and Health and Safety Executive. There are other agencies in addition to those listed that may not 
           be given access to NCOA Update.        
    6.  Security and Control 

    6.1 The Client and/or End User shall indemnify and hold CCD from and against any and all liabilities, damages, losses, expenses, demands,
          claims arising out of or in connection with any and all use of CCD Data unauthorised by any third party.

    7.  Warranties and Liability 

    7.1 The Parties warrant to each other that they each have full power, right and authority to enter into this Agreement.

    7.2 CCD warrants that:

    7.2.1   it has the right, via its agreement with CCD data suppliers, to sell CCD Data to the End User for the Purpose;

    7.2.2   CCD has sought the relevant assurances from CCD data suppliers that CCD has been collected in compliance with the Applicable 

    7.3      The Client acknowledges and agrees that:

    7.3.1   CCD is the supplier acting on behalf of CCD data suppliers;

    7.3.2   CCD can make no (and has not made any) representation nor give (and has not given) any warranty or undertaking as to 
               the suitability of CCD Data for any purposes of the Client and/or End User;
    7.3.3   CCD will not be liable for any loss, damage or inconvenience whatsoever caused by any inaccuracies in the CCD Data;

    7.4 The End User warrants that it will fully and effectively indemnify CCD against liability (including but not limited to all claims, 
          judgments, costs and other liabilities) which CCD may incur by reason of the Client’s and/or End User’s activities in connection 
          with CCD Data.
    8.  Confidentiality

    8.1 Each Party agrees not to use or reveal the Confidential Information disclosed to it by the other Party for any purpose except 
          to further the objective of the Agreement.  Each Party agrees that it will take all reasonable measures to protect the secrecy of 
          and avoid disclosure or use of Confidential Information of the other in order to prevent it from falling into the public domain or 
          possession of persons other than those persons authorized hereunder to have any such information, which measures shall include at 
          least a reasonable degree of care.  This provision shall be binding on the Parties and shall be treated and safeguarded hereunder by 
          the receiving Party notwithstanding the termination or expiry of this Agreement.

    8.2 Each Party shall keep confidential all provisions of the Agreement and shall not make any public announcement of it or its subject 
         matter without the other Party’s prior written consent.

    9   Termination

    9.1 CCD may terminate the Agreement with immediate effect on giving written notice to Client if the Client and/or End User for any of the

    9.1.1   has used CCD Data outside the terms of the Agreement;

    9.1.2   commits any breach of the Agreement which in the sole discretion of CCD cannot be remedied; 

    9.1.3   convenes a meeting of its creditors or if a proposal shall be made for a voluntary arrangement within Part 1 of the Insolvency 
               Act 1986 or a proposal for any other composition scheme or arrangement with (or assignment for the benefit of) its creditors or if the 
               Client shall be unable to pay its debts within the meaning of Section 123 of the Insolvency Act 1986 or if a trustee, receiver, 
               administrative receiver or similar officer is appointed in respect of all or any part of the business or assets of the Client or if a 
               petition is presented or a meeting is convened for the purpose of considering a resolution or other steps are taken for the winding up 
               of the Client or for the making of an administration order (otherwise than for the purpose of an amalgamation or reconstruction of a 
               solvent company) or any other analogous event occurs in respect of or relating to the Client.

    10. VAT 
          Save insofar as otherwise expressly provided, all amounts stated in the Order Confirmation are exclusive of amounts in respect of Value 
          Added Tax chargeable for the time being (“VAT”). Where any taxable supply for VAT purposes are made under the Order Confirmation the 
          Client shall, on receipt of a valid VAT invoice from CCD, pay to CCD such additional amounts in respect of VAT as are chargeable on the 
          supply of CCD Data as at the same time as payment is due for the supply of the CCD Data.

    11. Governing Law and Submission to Jurisdiction

    11.1    The construction, validity and performance of the Agreement shall be governed by and construed in all respects in accordance 
               with English law.
    11.2    All disputes arising in any way out of or affecting this Agreement shall be subject to the exclusive jurisdiction of the English 
               Courts to which the Parties agree to submit.

Close Match Rates/Costs?

To register, submit jobs and receive match reports there are no charges.

To actually append channel items (append email address or append
postal name and address) there are three different credit/payment terms,
each one suited for a specific type of user.

1) Minimum monthly payment of £250.00, which is all consumable, with any excess charged at rate(s) specified - this is aimed at debt recovery companies or those users who'll be using the service frequently, but submitting low data volumes.

2) Invoice issued after append with 30 day payment terms - for less frequent users but who'll typically be submitting larger volumes. This can be provided after the usual credit checks have been undertaken and an account set-up accordingly.

3) Credit Card Payment - this option allows users to immediately append data without the need for credit checks and is suited to small low volume infrequent users.

The minimum charge per append (append email address or append postal name and address) is £100.00 but this is consumable and does not apply to those users who have chosen the minimum monthly payment option.

With over 102 million records we have the single largest source of data for e-append.

User registration will be available on 16th January 2014.
Every user of the system is expected to have read and understood our Refund Policy. consumerchanneldata.co.uk understands
that a report or output may not be what you expect it to be. In this regard, we have devised this procedure to facilitate any concern.

Step 1 - Post the following information to our Contact Us page within 10 days after receipt of the report or output:

       •	Job Reference Number
       •	Concern/Complaint details
Step 2 - Await Support Team's confirmation of receipt of your email, which will include a Ticket Number. 
              Please use this ticket number in all correspondences relating to the concern to facilitate fast and efficient processing.

Step 3 - The Support Team will again contact you for the feedback and/or resolution to the concern/complaint.
